Overview
This statement supplements our Privacy Policy and describes the rights of California residents under the California Consumer Privacy Act (CCPA), as amended by the California Privacy Rights Act (CPRA).
MomGainz is a local-first app: we do not operate accounts or servers, and we do not collect or store personal information about our users ourselves. A limited slice of training data is sent to our AI provider (Groq) only when you actively use an AI feature. See our Privacy Policy for the full picture.
This page explains your rights as a California resident and how to exercise them, even though — based on our current architecture — the main way to exercise most of these rights is to use the app's built-in Delete All Data feature, because we do not hold a central copy of your data.
Categories of Personal Information We Handle
The categories below reference CCPA's statutory definitions. In MomGainz, the data in each category lives on your device — we do not receive or store it centrally.
- Identifiers: None collected. MomGainz has no user accounts, no email sign-up, no device-ID tracking.
- Commercial information: Your subscription status (active or not), managed entirely by Google Play. We receive a subscription entitlement token from Google Play; we do not see your payment method, name, or billing address.
- Internet or other network activity information: None collected. We do not run analytics SDKs, crash reporters, or advertising trackers.
- Geolocation data: None collected.
- Audio, electronic, visual, thermal, olfactory, or similar information: Progress photos you add to weekly check-ins and exercise reference images you upload remain on your device.
- Professional or employment-related information: None collected.
- Education information: None collected.
- Inferences drawn from personal information: Workout suggestions and progression recommendations are generated from data on your device; when you use AI features, a limited summary is sent to Groq to generate a response (see the AI Disclosure).
- Sensitive personal information (CPRA): Health and fitness data (workout logs, body weight, postpartum status, diastasis self-check result) and, if you connect it, Apple Health or Health Connect data. All of this stays on your device.
Sources of Personal Information
We only "receive" personal information in the sense that you, the user, enter it into the app on your device. We do not purchase data, receive data from third-party marketers, or scrape public sources.
Purposes for Using Personal Information
- To run the app's features (workout tracking, progression suggestions, reminders, streak tracking) — done on your device.
- To generate AI responses when you explicitly use an AI feature — a limited summary is sent to Groq. See the AI Disclosure.
- To determine your subscription entitlement — handled by Google Play.
Sharing and Sale of Personal Information
We do not sell or share your personal information. We do not trade data to advertisers or marketers. Because we do not have a central copy of your data, there is nothing for us to sell.
The only third parties that receive any slice of your data are:
- Groq — when you actively use an AI feature, a limited training-context summary is sent to generate a response. Groq's policy states API requests are not used to train their models.
- Google Play — handles subscription billing and returns an entitlement token to the app.
Your California Privacy Rights
If you are a California resident, you have the following rights:
Right to Know
You have the right to request disclosure of the categories of personal information we collect, sources, purposes, and any categories shared. This page and our Privacy Policy provide that disclosure. Because your personal data lives on your device, you can always view it directly inside the app.
Right to Delete
You have the right to delete personal information held about you. You can exercise this directly at any time:
- Inside the app: Settings → Delete All Data — wipes all locally stored data.
- Uninstall the app — removes all data per your operating system's standard behavior.
- Request Groq delete any residual API-request data: see the AI Disclosure for Groq's retention window.
Right to Correct
You have the right to correct inaccurate personal information. Because your data is on your device and editable inside the app (Profile, Edit Profile, Settings), you can correct it directly at any time.
Right to Opt Out of Sale or Sharing
We do not sell or share your personal information for cross-context behavioral advertising. There is no opt-out required because the activity does not occur.
Right to Limit Use of Sensitive Personal Information
Sensitive personal information (health and fitness data) is used only to power the features you use in the app. It is not used for profiling, advertising, or any secondary purpose. No separate opt-out is required.
Right to Non-Discrimination
We will not discriminate against you for exercising any of these rights. The app will continue to work the same whether or not you exercise any right.
How to Exercise Your Rights
Because we do not hold a central copy of your data, most rights are exercised directly in the app or on your device:
- Delete all data: Inside the app, go to Settings → Delete All Data.
- Correct your data: Go to Profile → Edit Profile or Settings.
- Disconnect Apple Health / Health Connect: Via your device's health settings.
If you need something we cannot address through the app (for example, a question about Groq's handling of your data), email support@theyardapps.com and we will respond within 45 days as required by CCPA.
Children Under 16
We do not knowingly collect personal information from children under 13 (COPPA) or users under 16 (CCPA Shine the Light). MomGainz is designed for adult use. If you believe a child under 13 has used the app, you can wipe all data via Settings → Delete All Data.
Subscription Auto-Renewal (California ARL)
If you subscribe to MomGainz Premium:
- Subscriptions auto-renew until you cancel.
- Renewal price: $6.99/month or $49.99/year, as displayed at purchase.
- You can cancel at any time via Google Play: play.google.com/store/account/subscriptions. Access continues until the end of the current billing period.
- No refunds for partially used periods, consistent with Google Play's refund policy.
Changes to This Statement
We may update this statement from time to time. If we make material changes, we will update the effective date above.
